The Left Lane℠, an independent contractor of Travel Success Academy, is pleased to assist you with your travel arrangements. By booking a vacation with Stacey Patterson dba “The Left Lane” you agree to the following terms and conditions:

1) Research/Information Fee. This fee is incurred when you (“the client”) enlist the services of The Left Lane as compensation for the time dedicated to research destinations and applicable travel information. A non-refundable research fee of $100 will be required to initiate the development of your quote for domestic vacation rentals and hotels, and for international destinations and/or cruises (this fee may be higher, depending on complexity of the itinerary and any additional costs will be discussed during consultation). FOR GROUPS REQUIRING MORE THAN 8 ROOMS OR CABINS AND/OR LOOKING TO BLOCK GROUP SPACE: The research fee is $250. This fee can be paid via our merchant account with TravelJoy, PayPal, or by using waveapp to Stacey Patterson dba “The Left Lane” at time of service. This fee includes a maximum of three options in response to your initial destination request. (Additional options will require an additional research fee.) Service fee and proposal are valid for a period of 30 days. Any outstanding proposals that have not been accepted and deposited within 30 days of receipt will expire and be considered void. Additional fee will be required for repricing.

2) Products and Suppliers. We sell travel related products from several suppliers and service providers (“suppliers”). While each supplier has its own terms and conditions, applicable to your individual booking, our terms and conditions are applicable in addition to those of the suppliers and all travelers should be aware of and understand each.  Additionally, The Left Lane℠ does not own or operate any of, hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related suppliers who provide goods or services for the client(s)’ trip.  The client(s) acknowledge and agree that The Left Lane℠ shall not be responsible for any loss, damage, delay, inconvenience or injury to the client(s) or group members utilizing the respective service. The client further understands The Left Lane℠ is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, theft, property damage, or other damages or expenses resulting therefrom. We have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond our control, and we have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority. Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. The client(s) acknowledge and agree that The Left Lane℠ is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.  The Left Lane℠ is not liable for any loss due to the client’s gambling and is not responsible for any purchases made while on the trip.

3) Pricing. Prices are subject to change without notice until a full deposit is submitted. We will not be held liable for changes in availability, price or itinerary. 

4) Payment of Reservations. Payments will be submitted via our Merchant Account, TravelJoy and will appear on your billing statement as “TJ* The Left Lane”. Please ensure that payments are submitted in accordance to your invoice giving particular attention to your final payment date. Failure to make your final payment on time may result in the cancellation of your reservation WITHOUT refund. In the event that there is a need to extend your final payment date, please let us know as early as possible and we will attempt to obtain an extension on your behalf from our suppliers. Please note that extensions are either granted or denied by our suppliers on a case by case basis and are NOT guaranteed. Your reservation will still be subject to cancellation until you are informed otherwise. 

5) Identification. Clients are required to make reservations in the full name that is listed on the government-issued form of identification that he/she will use for travel. If the client needs to make any changes to their name after travel documents have been issued, the clients will be responsible for all name change fees, if applicable. 

6) Passports and Visas. Clients are responsible for ensure that he/she fulfills the passport, visa and other immigration requirements applicable to their itinerary. The client should check with the respective consulate(s) or visa agency to determine visa and/or passport requirements. Passport books must be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. We do not assume any responsibility in the case of a client being unable to travel due to the client’s failure to comply with any such requirements. The client is also required to carry a valid International Student I.D., and International Youth I.D. or an International Teacher I.D. card if he/she is traveling on a special student/youth/teacher ticket. It is the client’s responsibility to verify applicable requirements. We strongly suggest that cruise passengers have a valid passport in their possession while cruising.

7) Reservation Documentation Review. It is the client’s responsibility to ensure that all of the details on their travel documents are correct and to bring to our attention any errors or discrepancies immediately in order to avoid additional fees. The client will be instructed to review reservations as soon as possible (within 24 hr of receipt). Failure to identify discrepancies within 24 hours of the receipt of booking confirmation will constitute the client’s acceptance of the booking’s details as accurate. Any associated change/correction fees will be the responsibility of the client. Additionally, your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. 

8) Changes. All changes to your reservation are subject to the change fees and or price adjustments specified by the travel supplier. Where a change requested by the client is permitted, a service fees in the amount of $50 will be applied in addition to any additional supplier charges. Please note that all reservation changes are subject to availability and the terms and conditions applicable to the product purchased. Changes to name details are not allowed by many airlines and other suppliers. Please also note that most airlines and suppliers treat a name change as a cancellation, to which standard conditions and charges would apply. We will inform you of any such charges, specific to you reservation, prior to making any adjustments to your booking. Additionally, flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you do not intend to take a flight as reserved, please contact us or the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges and/or your flight itinerary being cancelled and/or render your ticket void.

9) Final Payment Deadline. If a client’s reservation is canceled due to failure to meet a final payment deadline, neither The Left Lane℠, nor our host agency will not be held liable for any loss of funds or the cancellation of said reservation. 

10) Travel Documents. Provided full payment is received no later than your Final Payment Due date, travel documents and travel instructions will be sent via email and/or mail 30 days or earlier prior to travel. If paper documents are requested when e-documents are available, documents will be delivered via USPS approximately 14-21 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes). 

11) International Travel. Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.

12) Travel Advice and Vaccinations. U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places within your itinerary. It is your responsibility to ensure that you have arranged all necessary and required vaccinations.

13) COVID-19 Waiver of Liability. In Spring 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Center for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC website at www.cdc.gov. The client understands and agrees to the following: 

  1. COVID-19 is a highly contagious virus that can be spread via person to person contact; 
  2. After reasonable inquiry, The Left Lane℠ provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary. 
  3. Supplier(s) of The Left Lane℠ may have policies in place to help prevent the spread of COVID-19. The Left Lane℠ is not the drafter or holder of those policies and I understand that these policies can change at any time; 
  4. I understand that the supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate; 
  5. I understand that each state/country institutes their own pandemic protective policies and regulations. I further understand that I am responsible for knowing, understanding and abiding by the pandemic protective policies and procedures regarding COVID-19 of all state(s)/country(ies) listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control; 
  6. I understand that by traveling, I may be subject to voluntary or involuntary quarantine either at home or in the traveled location(s); 
  7. I am responsible for knowing, understanding and abiding by the pandemic protective policies and procedures regarding COVID-19 of all vendors used in my travel itinerary, including any policy updates;  
  8. With full awareness and appreciation of the risks involved, I, for myself, and on behalf of my traveling companions, including, but not limited to, my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release The Left Lane℠, its officers, agents, independent contractors, affiliates, employees, successors, host agency, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with The Left Lane℠;
  9. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of The Left Lane℠ services, or the services of travel The Left Lane℠ suppliers or vendors, specifically related to COVID-19.

14) Travel Insurance/Protection. Travel insurance is the best way to protect your investment and your wallet in the unfortunate event of a medical emergency. We strongly recommend that you have secure adequate insurance for the duration of your vacation which will provide coverage for Trip Cancellation, Interruption, Baggage Loss or Delay, Medical Expenses and more. In some cases, our travel suppliers will offer “Travel /Trip Protection”, which may or may not provide the same coverages as travel insurance. Such protection may not offer a cash refund in the event of a protection claim, but instead a travel credit to be utilized with the supplier at a later date. It is the client’s responsibility to review and understand the terms of  any insurance or protection plans and to address any questions in regard to such policy/plan with the policy/plan provider. Travel insurance is a mandatory element of some travel arrangements. We may be able to arrange travel insurance to be provided to you, furnish you a quote, and answer any queries you may have regarding the insurance. Guests declining insurance will be required to sign a waiver prior to receiving their travel documents. In the event that you need to file a claim, we will supply the necessary information to initiate this process.  The client is responsible for initiating the claim process and supplying the necessary information to the insurance company to facilitate their claim.  The Left Lane℠ does not make representations as to the payment or denial of your claim and will not be held liable for the outcome of your claim. By booking travel with The Left Lane℠ the client agrees to indemnify and hold harmless The Left Lane℠ from legal actions arising from or relating to the insurance company’s ruling.

15Cancellation. Once reservations have been made, cancellations will only be accepted in writing. Email your cancellation request to info@theleftlanetravelpro.com with your invoice number, full name, and date of travel. Cancellations are posted on the day that the cancellation request is received by The Left Lane℠ provided it is received before 4:00 p.m. Eastern Standard Time Monday – Friday.  All other cancellations will be posted on the next business day. If you do not receive an acknowledgement within 1 business day, please call (779) 778-2229 to ensure your information was received. Please note that a cancellation does not always result in a refund. If you cancel your booking without insurance, after final payment/due date you will forfeit all monies paid. If you cancel your arrangements prior to your final payment/due date with or without insurance, your right to a partial refund may be limited. In addition to the cancellation terms and conditions of the supplier(s), our standard cancellation policy will apply and is as follows: Deposits are non-refundable; A $500 cancellation fee will apply for refund requests made between 30 days after deposit and 181 days prior to departure. (in addition to deposit); A 25% cancellation penalty will apply for refund requests made between 180 and 121 days prior to departure; A 50% cancellation penalty will apply for refund requests made between 120 and 61 days prior to departure; No refunds will be issued for cancellations made within 60 days of departure.

We are not responsible for a supplier’s failure to pay a refund. Please refer to your booking confirmation for the applicable cancellation schedule/penalties of the supplier. ALL PAYMENTS ON OUR GROUP TRIPS ARE NON-REFUNDABLE AND NON-TRANSFERABLE. Travel Insurance is highly encouraged!

16) Group Harmony. To ensure that a positive vacation experience is provided to the collective group and each individual within, The Left Lane reserves the right to accept, deny or expel any individual who is deemed disruptive or incompatible with the interests of the collective group or individuals within such that it causes a collective discord. Such circumstance is including, but not limited to, individuals who are intoxicated and/or under the influence of mood- or mind-altering substance leading to a negative experience for other group participants. Arrangement of alternate travel plans over the remainder of the trip and the return home, as well as the expense thereof, including cancellation fees and/or costs, will be the sole responsibility of the traveler. All unused services are non-refundable.

17) Departure Assistance. If you experience any difficulties during your vacation, please inform the relevant supplier (e.g. guest services) immediately. Should they be unable to resolve the matter, please immediately contact us: (779) 778-2229 and we will do our very best to resolve the issue on your behalf.

18) Children. All children under 18 must be accompanied by an adult. Accompanying adults are responsible for the safety of their children including providing any necessary safety equipment (such as infant/child seats) where appropriate. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be traveling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non-traveling parent, granting authorization to travel, including the dates of travel should be carried. 

19) Airlines. The Left Lane℠ is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice. The Left Lane℠ is not responsible for penalties incurred for tickets, international or domestic, due to schedule and/or flight changes. Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, The Left Lane℠ will require immediate and full payment of the airfare. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the same flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the passenger. Airline use of Insecticide Spray – Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft.  Federal law requires that we refer you to the Department of Transportation’s Disinfection Information page on their website at the time of booking for further information. http://airconsumer.dot.gov/spray.htmHazardous Materials Disclosure – Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. 20) Schedule Changes. In the event of an airline schedule change, The Left Lane℠ will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. The Left Lane℠ is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. The Left Lane℠ is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passengers’ responsibility to advise The Left Lane℠ of amended flight details in writing at info@thetheleftlanetravelpro.com. The Left Lane℠ cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge. 

21) Traveler Health. The Left Lane℠ recommends that all travelers be in good physical and mental health and have medical approval to travel. Any physical disabilities must be reported to The Left Lane℠ at the time of reservation upon initial booking so we can contact the suppliers to determine the availability of special amenities and/or accommodations.  The client is required to provide his/her own personal or individually prescribed devices such as wheelchairs, walkers, or similar devices. If more than minor assistance is needed, suppliers may require that the traveler be accompanied by a companion who is capable of, and responsible for, providing such assistance. Suppliers often reserve the right to reject travelers whose mental or physical condition may interfere with the itinerary. The client(s) acknowledge and agree that The Left Lane℠ shall be held harmless for any and all claims relating to supplier rejection relating to mental or physical condition.

22) Assumption of Risk. As the client, I am aware that travel such as that I am undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of The Left Lane℠, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am aware that weather conditions may be severe, adverse and/or unpleasant. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of The Left Lane℠ and agree to hold harmless and release The Left Lane℠ from claims of third party negligence. I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition.

23) Force Majeure. “Force Majeure” means, in relation to The Left Lane℠, any circumstances beyond our reasonable control (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). The Left Lane℠ shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. If The Left Lane℠ and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip.  The Left Lane℠ shall be entitled to deduct from any refund recoverable any applicable cancellation fees. Regarding civil unrest, political instability or unsafe conditions The Left Lane℠ reserves the sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to The Left Lane℠and each supplier’s terms and conditions.

24) Modification of Terms and Conditions.  These Terms and Conditions may be amended or modified by The Left Lane℠ at any time without notice.  It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time an order was placed by you. Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with The Left Lane℠.  Without this acceptance any order is subject to cancellation at any time. The failure of The Left Lane℠ to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. The Left Lane℠ does not guarantee it will take action against all breaches of this these Terms and Conditions.

25) Photographic Release. When present, The Left Lane℠ may take photographs or video which include trip participants. You grant The Left Lane℠ permission to do so and for us to use same for promotional or commercial use without payment of any compensation to participant.

26) Mandatory Arbitration/Forum/Choice of Law. The Parties hereby agree that any and all disputes arising out of or relating to this Agreement shall be submitted to final binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association and shall be governed by the laws of the State of Maryland.   The Parties agree that the arbitration shall take place in Prince George’s County, Maryland and will be conducted by a single mutually agreed upon arbitrator.  The arbitrator shall permit both sides to conduct reasonable discovery, in her/his sole discretion, and shall render a written award.  Payment of the cost of the arbitration, including the arbitrator’s fees and room rental, shall be split equally between the Parties.  Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

The Parties acknowledge and agree that this arbitration is their sole recourse and that they may not file a lawsuit against The Left Lane℠. If client(s) fails to submit their claim to arbitration and instead files suit, The Left Lane℠ shall be entitled to recover its attorney’s fees and other costs incurred in the enforcement of the terms of this Agreement, including costs incurred seeking referral to arbitration. The client(s) and The Left Lane℠ agree that neither party shall be entitled to join or consolidate claims or arbitrate any claim as a representative or class action.

This Agreement shall be governed by the laws of the State of Maryland without regard to its conflicts of laws principles. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.
